HB823. District Court; Expungement of Police and Court Records.

This bill adds § 19.2-392.2:1 to the Code of Virginia. The bill allows a defendant who is acquitted of a misdemeanor crime or has a charge dismissed against him with prejudice to immediately request the record is expunged. The judge will consider whether keeping records possibly creates circumstances that constitute a manifest injustice. The defendant will be charged $100 to have the record expunged.
