S.B. 1218, amended, but recommended for reporting

The Senate Courts of Justice Criminal Subcommittee this evening unanimously voted to recommend Senator Obenshain’s bill, S.B. 1218.  In its original form, this bill required juvenile probation officers to transmit probation and parole reports, including intake, social history and sentencing reports, to school superintendents.  It is unclear at this time how the amendments will read.

Representatives from Just Children and the MAJDC spoke out against the bill, despite both group’s acknowledging that they were pleased with the amendments made to the bill.   Amongst several arguments against this legislation are that currently, schools already receive notice of petitions filed against a student, disposition of those petitions, and when a child moves into a new school district, the new school district is informed of the child’s record.  JustChildren and the MAJDC both belive that this bill violates the due process rights of the child and also potentially compromises the child’s confidentiality.
