HB 1963 sent to the Crime Commission

The Criminal Subcommittee for the House Courts  Courts of Justice recommended sending HB 1963 to the Crime Commission.

The bill states that if conditions of registration as a sex offender are not alleged in the charging instrument, the Registry can obtain that information elsewhere, and require registration anyway.

HB 1928 approved by House of Delegates

HB 1928 was engrossed and amended HB 1928E on February 3, 2009.  The following day the  bill was unanimously approved by the House.

The bill would require registered sex offenders to notify the Registry of any change to their Internet protocol address or significant change in their appearance.

HB 1962 approved by House of Delegates

House Bill 1962 was unanimously approved by the House of Delegates on February 4, 2009.  The bill declares that court orders conflicting with current requirements for registration on the sex offender registry are null and void.

SB 861 is amended and reported

SB 861 was reported with amendment from the Senate Finance Committee on February 4th, 2009.  The vote was 16 to 0.

The amendment to SB 861 is as follows:

“That the provision of this act shall not become effective unless an appropriation of general funds effectuating the purpose of this act is included in general appropriations act passed by the 2009 Session of the General Assembly, which becomes law.”

SB 854 referred to Senate Finance Committee

Senate Bill 854, which creates a pilot program for mental health courts, was reported from the Senate Committee for Courts of Justice on February 4th, 2009.

House Bill 1695 will cross over to the Senate

HB 1695, which creates new penalties for driving without a license (including arrest and possible vehicle impoundment), was approved by House of Delegates on February 3, 2009.  The vote was 85 to 13.

The bill will now pass to the Senate, where it has been referred to the Senate Committee for Courts of Justice.
